On Wednesday, attorney Tommy R. Hastings of Hastings Law Firm P.C. held a press conference at the firm’s main office in The Woodlands. He explained the intention of the restraining order against Dr. J. Steve Bynon Jr., who has been accused of manipulating patient data in a manner that may have prevented eligible patients from receiving transplants.

“We filed a temporary restraining order against Dr. Steven Bynon, because obviously we have great concerns [sic],” Hastings said. “Anyone that has been accused of manipulating data in a transplant program is obviously [somebody] who could manipulate data on a telephone, in their email or in their personal notes. We feel that data should be preserved by a court order while this investigation is pending.”

He added that he hopes that both Dr. Bynon and Memorial Hermann will be completely transparent about any data that was altered, so anyone who lost a loved one during the period of alleged altered data can feel closure.

“I’m hopeful that it will,” he said. “If Dr. Bynon is listening to this—Dr. Bynon, we would appreciate it if you would come down and voluntarily agree to this restraining order and a court order that you will not be deleting any [data] while this is going on... If [Dr. Bynon] has any integrity as a physician, he’s going to openly tell everyone what happened here so people can have at least some sort of healing.”

According to Hastings, there will be a court hearing at the Harris County Ancillary Court tomorrow morning at 10:30 a.m. to determine whether the restraining order will be granted.
